Introduction and Acceptance
These Terms of Use (the “Terms”) govern access to and use of the Scuba mobile application, website, and related services (collectively, the “App”), operated by Align Dating Inc. (“Align”, “we”, “us”, or “our”). By clicking to accept these Terms, creating an account, or accessing or using the App, you agree to be bound by these Terms, our Privacy Policy, Cookie Policy, and our Community Guidelines, each of which is incorporated into this agreement by reference. If you do not agree to be bound by all of these terms, you must not access or use the App.
We reserve the right to modify, amend, or change these Terms at any time. Notice of any material change will be posted on this page with an updated effective date. We may notify you of a change to the Terms via email, in-app notification, or other means; however, you are responsible for regularly checking this page for any changes. Your continued use of the App after such changes become effective constitutes your binding acceptance of the updated Terms. If you do not accept a change to the Terms, you must stop accessing or using our Services immediately.

(“Align”, “we”, “us”, or “our”). By clicking to accept these Terms, creating an account, or accessing or using the App, you agree to be bound by these Terms, our Privacy Policy, Cookie Policy, and our Community Guidelines, each of which is incorporated into this agreement by reference. If you do not agree to be bound by all of these terms, you must not access or use the App.

We may notify you of a change to the Terms via email, in-app notification, or other means; however, you are responsible for regularly checking this page for any changes. Definitions
For the purposes of these Terms:
“App” means the Scuba mobile application, website, and all related services.
“User” or “you” means any individual who accesses or uses the App, excluding body corporates, business entities, and automated bots.
“Other Users” means other individuals who access or use the App.
“Content” means text, photos, profile information, birth details, preferences, messages, links, comments, responses, compatibility indicators, and other materials made available on or through the App.
“Your Content” means Content that you upload, submit, generate, transmit, or otherwise make available through the App.
“Other Users’ Content” means Content made available by Other Users.
“Our Content” means the App’s software, design, branding, interface, features, text, graphics, logos, compilations, and other content owned by Align or its licensors.
“Insights” means astrology-related, algorithmic, compatibility, matching, comparative, or profile-based outputs made available through the App.
“Third-Party Services” means websites, apps, event pages, venues, sign-in tools, payment tools, analytics services, referral tools, hosting services, or other external services that may be linked to, embedded in, or interact with the App.
“AI Tools” means any artificial intelligence, machine learning, automated content-generation, automated moderation, automated profiling, or automated assistance tools made available by us, used by users through the App, or used by us in connection with operation of the App.
Definitions
For the purposes of these Terms:
“App” means the Scuba mobile application, website, and all related services.
“User” or “you” means any individual who accesses or uses the App, excluding body corporates, business entities, and automated bots.
“Other Users” means other individuals who access or use the App.
“Content” means text, photos, profile information, birth details, preferences, messages, links, comments, responses, compatibility indicators, and other materials made available on or through the App.
“Your Content” means Content that you upload, submit, generate, transmit, or otherwise make available through the App.
“Other Users’ Content” means Content made available by Other Users.
“Our Content” means the App’s software, design, branding, interface, features, text, graphics, logos, compilations, and other content owned by Align or its licensors.
“Insights” means astrology-related, algorithmic, compatibility, matching, comparative, or profile-based outputs made available through the App.
“Third-Party Services” means websites, apps, event pages, venues, sign-in tools, payment tools, analytics services, referral tools, hosting services, or other external services that may be linked to, embedded in, or interact with the App.
“AI Tools” means any artificial intelligence, machine learning, automated content-generation, automated moderation, automated profiling, or automated assistance tools made available by us, used by users through the App, or used by us in connection with operation of the App.
3. Eligibility and Age Restriction
You may create an account and use the App only if you meet all of the following requirements, and by using the App, you represent and warrant that:
(a) you are at least 21 years old;
(b) you are legally capable of entering into a binding agreement;
(c) you are not prohibited by applicable law from using the App;
(d) you use the App only for personal, lawful, and genuine relationship-oriented purposes;
(e) you have never been convicted of a felony, an indictable offence, a sex crime, or any crime involving violence, and you are not required to register as a sex offender with any state, provincial, federal or local sex offender registry;
(f) you have not previously been removed, banned, or terminated from the App or any other Align service for a violation of our terms or guidelines; and
(g) you are not located in a country that is subject to a U.S. or Canadian government embargo, and you are not listed on any government list of prohibited or restricted parties (such as as the OFAC Specially Designated Nationals list).
You must provide accurate, current, and non-misleading information when creating and using your account. To maintain an active profile, you must upload at least one authentic photograph that clearly features your face.
We do not permit accounts for anyone under 21 or anyone who fails to meet these criteria. If you no longer meet any of the eligibility requirements above, your right to use the App automatically and immediately ends, and we may suspend or terminate your account without notice.
Reliance on User-Provided Information:
Align relies on the accuracy and completeness of the information you provide when creating and maintaining your account. While we may implement reasonable measures to promote authenticity and detect misuse, we do not and cannot independently verify all user-provided information in every case, including age, identity, relationship status, criminal history, sex offender registry status, or any other eligibility representation made under these Terms. By using the App, you acknowledge and agree that Align's ability to enforce eligibility requirements depends substantially on the truthfulness and accuracy of the information you provide. Any misrepresentation of your eligibility, identity, or personal information is a material breach of these Terms and may result in immediate suspension or termination of your account, without prejudice to any other rights or remedies available to Align under these Terms or applicable law.

The App is a dating and compatibility platform designed to allow users to create profiles, receive profile-based interactions and compatibility-related insights, discover potential connections, view local community recommendations, and communicate through available in-app features. Certain features may depend on the information you provide, your device, your location, or regional availability.
The App is not a matrimonial bureau, escort service, sugar-dating platform, prostitution-facilitation service, event organizer, background-check provider, identity-verification service, medical service, mental health service, crisis-response service, or guarantee of compatibility, safety, truthfulness, or relationship outcomes. The App offers suggestions, including listings for local cafes, third-party businesses, and community volunteer or "do-good" events, but does not guarantee the safety, quality, suitability, accessibility, legality, or quality, suitability, accessibility, legality, or operational status of these external locations or gatherings. Insights and astrology-related, AI-assisted, or algorithmic features, and venue recommendations are provided for informational, discovery and entertainment purposes only, do not constitute an endorsement, and may be incomplete, inaccurate, dynamic, biased, unavailable, or unsuitable for any particular purpose. We offer no guarantee of compatibility, physical safety, truthfulness, or specific relationship outcomes.
4. Purpose of the App
The App is a dating and compatibility platform designed to allow users to create profiles, receive profile-based interactions and compatibility-related insights, discover potential connections, view local community recommendations, and communicate through available in-app features. Certain features may depend on the information you provide, your device, your location, or regional availability.
The App is not a matrimonial bureau, escort service, sugar-dating platform, prostitution-facilitation service, event organizer, background-check provider, identity-verification service, medical service, mental health service, crisis-response service, or guarantee of compatibility, safety, truthfulness, or relationship outcomes. The App offers suggestions, including listings for local cafes, third-party businesses, and community volunteer or "do-good" events, but does not guarantee the safety, quality, suitability, accessibility, legality, or quality, suitability, accessibility, legality, or operational status of these external locations or gatherings. Insights and astrology-related, AI-assisted, or algorithmic features, and venue recommendations are provided for informational, discovery and entertainment purposes only, do not constitute an endorsement, and may be incomplete, inaccurate, dynamic, biased, unavailable, or unsuitable for any particular purpose. We offer no guarantee of compatibility, physical safety, truthfulness, or specific relationship outcomes.
5. Account Information and Security
To create and use an account, you may be required to provide personal information such as your name, email address, date of birth, birth time, birth city, gender, preferences, current city, location-related information, and photos. Some information may be required for the App to function as intended, and if you choose not to provide certain information, some features may be unavailable or may not function effectively.
You are responsible for maintaining the confidentiality of your login credentials, for all activity conducted through your account, and for promptly notifying us if you suspect unauthorized access or misuse. We may require email verification, account ownership verification, or other reasonable steps to protect the App and its users.
We use reasonable administrative, technical, and organizational safeguards designed to protect account and personal information; however, no method of transmission, storage, or electronic security is completely secure, and we cannot guarantee absolute security or that unauthorized access, loss, misuse, or disclosure will never occur.
5. Account Information and Security

6. User Content and Intellectual Property
You retain ownership of Your Content, subject to the rights granted in these Terms. By uploading or submitting Your Content, you grant Align a non-exclusive, worldwide, royalty-free, fully sub-licensable license to host, store, reproduce, format, transmit, display, use, modify, and process that content (including profile details, photos, and messages) solely for the operation, administration, moderation, security, improvement, and lawful provision of the App. You explicitly understand and agree that Align may access, review, scan, and process Your Content, including private text communications, using automated tools and human review where reasonably necessary to operate the App, detect safety violations, prevent fraud or impersonation, enforce these Terms, protect users, maintain platform integrity, and comply with legal obligations, in each case subject to our Privacy Policy.
You represent and warrant that you have the right to upload Your Content, that Your Content does not infringe third-party rights, and that it is not false, deceptive, unlawful, threatening, hateful, obscene, harassing, exploitative, or otherwise prohibited under these Terms. You remain solely responsible for Your Content and for the consequences of posting, sharing, or relying on it.
Other Users’ Content belongs to the user who posted it or to the person otherwise entitled to it. You must not copy, scrape, extract, reuse, republish, sell, exploit, train external artificial intelligence systems on, or otherwise use Other Users’ Content except as strictly necessary for personal use of the App as intended. Unauthorized scraping, harvesting, profile cloning, data extraction, and dataset-building are expressly prohibited.
If the App makes AI Tools available for profile drafting, message assistance, summaries, recommendations, moderation, matching, or other functions, outputs generated or assisted by those tools do not relieve you of responsibility for Your Content or conduct. You remain solely responsible for reviewing, editing, verifying, and deciding whether to use, post, send, or rely on AI-assisted outputs. We do not guarantee that AI-assisted outputs are accurate, safe, unbiased, lawful, appropriate, non-infringing, or fit for any purpose.
The App and Our Content, including software, design, branding, text, interfaces, outputs, and underlying systems, are owned by Align or its licensors and protected by applicable intellectual property laws. Except for the limited right to use the App in accordance with these Terms, no rights are granted to you.

The App and Our Content, including software, design, branding, text, interfaces, outputs, and underlying systems, are owned by Align or its licensors and protected by applicable intellectual property laws. Except for the limited right to use the App in accordance with these Terms, no rights are granted to you.
7. Acceptable Use and Prohibited Conduct
You may use the App only in a lawful, respectful, and relationship-oriented manner. You must not use the App for any unlawful, exploitative, harmful, deceptive, commercialized, or bad-faith purpose.
Without limiting the foregoing, you must not:
create a fake account, impersonate another person, catfish, use another person’s name, likeness, voice, image, credentials, biography, or identifying details without authorization, or otherwise misrepresent your identity, age, relationship intentions, affiliations, or authenticity;
upload false, misleading, manipulated, stolen, explicit, pornographic, obscene, vulgar, hateful, abusive, defamatory, or threatening content;
use slurs, sexually explicit propositions, coercive language, harassing language, stalking language, or other degrading or unsafe communications;
promote, solicit, arrange, advertise, or facilitate escort services, prostitution, transactional sexual services, sugar arrangements, compensated dating, or any exchange of intimacy for money, gifts, travel, accommodation, narcotics, psychedelics, or other value;
solicit or send money, crypto, gifts, investments, loans, or any monetary transfer through or in connection with the App;
use the App for scams, catfishing, phishing, financial fraud, extortion, blackmail, romance fraud, or misleading solicitations;
promote, distribute, or encourage illegal drugs, narcotics, psychedelics, controlled substances, illegal paraphernalia, or unlawful intoxication-related activity;
upload or share content involving minors, sexual exploitation, violence, coercion, or non-consensual imagery;
collect, harvest, track, or disclose another user’s personal information without authorization;
share malware, malicious links, deceptive links, spam, or unauthorized promotions;
use bots, scripts, crawlers, scrapers, browser automation, API workarounds, account farms, or other automated means to access, monitor, interact with, or extract data from the App;
reverse engineer, copy, test, probe, interfere with, or exploit the App, its code, its systems, or its matching, recommendation, moderation, or insight logic except to the extent such restriction is prohibited by law;
use third-party artificial intelligence tools or automated systems to impersonate another person, mass-generate profiles or messages, evade moderation, manipulate matches, simulate human engagement, or create deceptive or misleading interactions on the App;
create a new account after suspension, restriction, or termination without our express permission;
encourage or facilitate any illegal activity, including terrorism, human trafficking, child exploitation, or the incitement of violence or hatred;
encourage or facilitate any activity that may result in physical harm to yourself or another person, including self-harm, eating disorders, or dangerous challenges;
distribute commercial spam, promote unapproved business ventures, or advertise “sugar daddy/ baby” relationships;
upload content that is automatically generated by external third-party software, or content that deliberately defames Align and its affiliates;
misuse any event registration, RSVP, or communication feature to harass, stalk, track, or intentionally mislead other users, or use the App to coordinate any offline meetings in bad faith;
use the App for any purpose inconsistent with its intended use as a personal dating and compatibility platform.
7. Acceptable Use and Prohibited Conduct
You may use the App only in a lawful, respectful, and relationship-oriented manner. You must not use the App for any unlawful, exploitative, harmful, deceptive, commercialized, or bad-faith purpose.
Without limiting the foregoing, you must not:
create a fake account, impersonate another person, catfish, use another person’s name, likeness, voice, image, credentials, biography, or identifying details without authorization, or otherwise misrepresent your identity, age, relationship intentions, affiliations, or authenticity;
upload false, misleading, manipulated, stolen, explicit, pornographic, obscene, vulgar, hateful, abusive, defamatory, or threatening content;
use slurs, sexually explicit propositions, coercive language, harassing language, stalking language, or other degrading or unsafe communications;
promote, solicit, arrange, advertise, or facilitate escort services, prostitution, transactional sexual services, sugar arrangements, compensated dating, or any exchange of intimacy for money, gifts, travel, accommodation, narcotics, psychedelics, or other value;
solicit or send money, crypto, gifts, investments, loans, or any monetary transfer through or in connection with the App;
use the App for scams, catfishing, phishing, financial fraud, extortion, blackmail, romance fraud, or misleading solicitations;
promote, distribute, or encourage illegal drugs, narcotics, psychedelics, controlled substances, illegal paraphernalia, or unlawful intoxication-related activity;
upload or share content involving minors, sexual exploitation, violence, coercion, or non-consensual imagery;
collect, harvest, track, or disclose another user’s personal information without authorization;
share malware, malicious links, deceptive links, spam, or unauthorized promotions;
use bots, scripts, crawlers, scrapers, browser automation, API workarounds, account farms, or other automated means to access, monitor, interact with, or extract data from the App;
reverse engineer, copy, test, probe, interfere with, or exploit the App, its code, its systems, or its matching, recommendation, moderation, or insight logic except to the extent such restriction is prohibited by law;
use third-party artificial intelligence tools or automated systems to impersonate another person, mass-generate profiles or messages, evade moderation, manipulate matches, simulate human engagement, or create deceptive or misleading interactions on the App;
create a new account after suspension, restriction, or termination without our express permission;
encourage or facilitate any illegal activity, including terrorism, human trafficking, child exploitation, or the incitement of violence or hatred;
encourage or facilitate any activity that may result in physical harm to yourself or another person, including self-harm, eating disorders, or dangerous challenges;
distribute commercial spam, promote unapproved business ventures, or advertise “sugar daddy/ baby” relationships;
upload content that is automatically generated by external third-party software, or content that deliberately defames Align and its affiliates;
misuse any event registration, RSVP, or communication feature to harass, stalk, track, or intentionally mislead other users, or use the App to coordinate any offline meetings in bad faith;
use the App for any purpose inconsistent with its intended use as a personal dating and compatibility platform.
8. Interactions, Safety, Communications, and Third-Party References
We do not guarantee the identity, authenticity, intentions, conduct, or truthfulness of any user, and we do not guarantee that profiles, messages, or other user interactions are free from impersonation, catfishing, bots, AI-generated content, scams, deepfakes, synthetic media, manipulation, harassment, or hateful, obscene, vulgar, abusive, or otherwise offensive content. We do not conduct universal background checks, identity verification, or health-status verification on all users.
You use the App and interact with Other Users at your own discretion and risk. Any decision to communicate, share personal information, click a link, meet offline, attend an activity, visit a venue, register for an event, or rely on anything stated by another user is entirely your responsibility.
The App may feature lists, interactive indexes, or mapping details pointing to external locations such as local cafes, public locations, third-party businesses or hosted community “do-good” events, and may redirect you to Third-Party Services for registration, information, or referrals. These inclusions are generated for user discovery and lifestyle context only. Align does not own, run, operate, manage, supervise, or endorse any cafe, venue, or community event referenced on the App. You acknowledge that your physical attendance at any cafe or community event, and your off-App interactions with any other user or coordinator at such locations or any other location, is entirely voluntary and executed at your own risk. Align expressly disclaims any and all liability for personal injury, illness, food safety issues, property damage, loss, dispute, fraud, scheduling adjustments, cancellations, or criminal acts occurring at any location or in connection with these external locations, venues or community events, or caused by the acts of other attendees or venue staff.
The App may permit text-based chat or other communications between users. Media sharing, file sharing, or hyperlinking may be limited, monitored, filtered, or disabled. Users should assume that communications may be preserved, screenshot, copied, or shared by recipients, and should act accordingly.
Absolute User Autonomy and Right to Cancel:
Align Dating Inc. does not monitor, control, or supervise real-world meetups or dates coordinated through the App. You retain total, absolute autonomy over your physical interactions. You have the uninhibited right to cancel, modify, or decline to attend any offline gathering, date, cafe visit, or community meetup at any time, for any reason, at your sole discretion. Exercising your personal judgment to cancel a meetup for reasons of safety, comfort, or convenience will never result in an account penalty, suspension, or termination. Your physical safety and personal comfort always take priority over any interaction coordinated via the Platform.
8. Interactions, Safety, Communications, and Third-Party References
We do not guarantee the identity, authenticity, intentions, conduct, or truthfulness of any user, and we do not guarantee that profiles, messages, or other user interactions are free from impersonation, catfishing, bots, AI-generated content, scams, deepfakes, synthetic media, manipulation, harassment, or hateful, obscene, vulgar, abusive, or otherwise offensive content. We do not conduct universal background checks, identity verification, or health-status verification on all users.
You use the App and interact with Other Users at your own discretion and risk. Any decision to communicate, share personal information, click a link, meet offline, attend an activity, visit a venue, register for an event, or rely on anything stated by another user is entirely your responsibility.

Absolute User Autonomy and Right to Cancel:
Align Dating Inc. does not monitor, control, or supervise real-world meetups or dates coordinated through the App. You retain total, absolute autonomy over your physical interactions. You have the uninhibited right to cancel, modify, or decline to attend any offline gathering, date, cafe visit, or community meetup at any time, for any reason, at your sole discretion. Exercising your personal judgment to cancel a meetup for reasons of safety, comfort, or convenience will never result in an account penalty, suspension, or termination. Your physical safety and personal comfort always take priority over any interaction coordinated via the Platform.
9. Reporting, Moderation, and Enforcement
If you believe that a user, profile, message, event reference, or other content violates these Terms or presents a safety, fraud, impersonation, harassment, exploitation, or legal concern, you may report it through the in-app tools we make available or by contacting us at the support contact listed below. Reports should be made honestly and in good faith.
We may use automated tools, AI-assisted moderation tools, keyword filters, human review, user reports, and other reasonable moderation methods to detect, review, remove, restrict, preserve, or investigate content, accounts, or conduct for safety, security, legal, operational, or compliance purposes, subject to applicable law and our Privacy Policy.
We reserve the right, where we consider it necessary or appropriate, to take action, including:
issuing a warning;
removing or restricting content;
disabling messaging or feature access;
unmatching users or limiting visibility;
suspending an account temporarily or permanently;
terminating an account;
preventing re-registration or blacklisting a user from future access;
banning, restricting, or preventing a user from registering an account on the App or any other current, affiliated, or future platform operated by Align Dating Inc. or its corporate parents and subsidiaries; and
preserving relevant information for investigation, legal compliance, safety review, or enforcement purposes.
For privacy, safety, and integrity reasons, we are not required to disclose the outcome of any internal review, investigation, moderation decision, or enforcement action.

10. Privacy, Deletion, Billing, and Account Status
Your use of the App is also governed by our Privacy Policy and any Cookies Policy, which describe how personal information may be collected, used, disclosed, stored, retained, and safeguarded. By using the App and providing profile, preference, birth, location, and photo information, you acknowledge that such information may be processed for the purposes described in these Terms and the Privacy Policy.
You may request the deletion of your account by following the process made available by us. We may require reasonable verification before processing deletion. Even after deletion, we may retain certain information for legal, fraud-prevention, safety, dispute-resolution, backup, tax, or compliance reasons, and may retain de-identified or aggregated information where permitted by law. If an account remains inactive for a prolonged period, including 12 consecutive months, we may deactivate, delete, anonymize, or limit associated information in accordance with our retention practices.
SERVICE FEES AND SUBSCRIPTION TERMS: Access to base features of the Scuba App is currently provided to you free of charge. Align reserves the right to introduce premium features, paid tiers, ad-supported components, or recurring membership plans in the future. In the event that premium features or payment structures are introduced, you will be given clear notice and options before incurring any charges.
CRITICAL NOTE ON FUTURE SUBSCRIPTIONS AND PURCHASES: In the event you activate or purchase any premium feature, subscription, or virtual currency in the future, you understand that deleting the Scuba mobile application from your device, or choosing to delete or deactivate your Scuba profile, DOES NOT cancel, pause, or terminate any active paid subscription or recurring billing cycle associated with your account. If you purchased a premium subscription or virtual items through a third-party marketplace (such as the Apple App Store or Google Play Store), you must manually cancel your subscription directly through your respective Apple ID or Google Play account settings to prevent future automated charges. All purchases are final and non-refundable except where required by mandatory local laws or applicable Google or Apple policy.
If we receive notice that a user has died, we may suspend, memorialize, restrict, or delete the account, or otherwise handle it in accordance with our internal policies, the deceased user’s known instructions if any, applicable law, and legitimate privacy, safety, and operational considerations. We are not required to permit ongoing access to a deceased user’s account, messages, or content merely because a person claims to be a family member, beneficiary, legal heir, executor, estate trustee, or other representative.
Where a person claims authority to act on behalf of a deceased user, we may require documents reasonably satisfactory to us before taking any action, including a death certificate, probate or court-issued appointment materials, a certificate of appointment of estate trustee, will extracts, proof of identity, and any other information reasonably necessary to verify authority and assess the request. We may refuse access, decline to disclose communications, or limit disclosure to account-level information, where required or appropriate for privacy, contractual, evidentiary, safety, or legal reasons.
No person may access or continue using a deceased user’s account credentials unless expressly authorized by us. A deceased user’s account is personal to that user and is not transferable by operation of inheritance, succession, or otherwise, except to the limited extent disclosure or handling is required by applicable law or expressly approved by us in writing. We may require estate trustees or other representatives to communicate through our designated legal or privacy channel rather than attempting direct access to the account.

Without limiting the foregoing, we do not guarantee uninterrupted access, error-free operation, accurate matching, compatibility, relationship success, user authenticity, off-App safety, event quality, venue quality, profile truthfulness, or the correctness of any insight, score, recommendation, referral, or AI-assisted, algorithmic, or astrology-related output.
To the fullest extent permitted by law, Align and its directors, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, reputation, data, opportunity, or goodwill arising from or related to the App, user conduct, off-App interactions, third-party references, third-party services, localized cafe or venue recommendations, third party organized volunteer/ do-good events, or any reliance on content or insights made available through the App. Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.
You agree to indemnify and hold harmless Align and its affiliates, personnel, and representatives from and against claims, losses, liabilities, damages, and costs arising from your breach of these Terms, your unlawful conduct, your infringement of third-party rights, your misuse of the App, or Your Content.
11. Disclaimers, Limitation of Liability, and Indemnity
The App is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Without limiting the foregoing, we do not guarantee uninterrupted access, error-free operation, accurate matching, compatibility, relationship success, user authenticity, off-App safety, event quality, venue quality, profile truthfulness, or the correctness of any insight, score, recommendation, referral, or AI-assisted, algorithmic, or astrology-related output.

12. Dispute Resolution: Class Action Waiver and Governing Law
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT WHERE APPLICABLE CONSUMER PROTECTION LAWS (INCLUDING THE ONTARIO CONSUMER PROTECTION ACT, 2002) EXPRESSLY PROHIBIT SUCH A WAIVER, YOU AND ALIGN AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE APP, OR OUR SERVICES WILL BE RESOLVED SOLELY ON AN INDIVIDUAL BASIS. YOU EXPLICITLY WAIVE ANY RIGHT TO FILE, JOIN, PARTICIPATE IN, OR MAINTAIN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE ACTION AGAINST ALIGN OR ITS AFFILIATES.
In the event of a dispute, you agree to first contact us at our designated legal email to attempt an informal, good-faith negotiation for at least thirty (30) days before initiating any formal legal or court proceedings.
We may modify the App or these Terms from time to time. If we make material changes, we may provide notice through the App, website, or email. Continued use after the updated Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law, and we may require renewed acceptance for certain changes where appropriate.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You attorn to the exclusive jurisdiction of the courts of Ontario located in Toronto, unless mandatory applicable consumer protection law requires otherwise.
